Removal of Conditions for Unrestricted use of Single Dwelling

A client approached us to seek advice for the removal of conditions that was stopping the unrestricted use of a dwelling following the historic imposition of a Section 106 Legal Agreement. The building was a former dairy parlour which had earlier been granted planning permission as a two-bedroom holiday let. There were also two planning conditions which sought to restrict the use of the building as a holiday let.

Upon instruction, Bloomfields approached colleagues at this Sussex-based Council in relation to the removal of the conditions. Following this, a strategy as agreed and evidence as to the historic use of the building was provided, including Statutory Declarations, to assist with a full planning application. A positive outcome was achieved with the lawful status being obtained to now use the building as a single dwelling, overcoming the historic planning conditions relating to the building.
