Conditions
We have worked with and have access to a range of specialist consultants to ensure that technical details often required can be adequately demonstrated. This includes satisfying conditions relating to matters such as highways, contamination, flood risk, ecology, sustainability and landscape. We can offer advice as to whether conditions meet six legal tests, and whether an appeal is worthwhile. We can also advise whether it is possible to demonstrate that non-compliance with a condition has occurred for sufficient time to warrant it being legally unenforceable. Bloomfields can make applications to vary and/or remove conditions. Such an example might include the removal of an agricultural occupancy condition (AOC).
