Retrospective Green Belt Application and Dealing with Enforcement

Bloomfields was approached after two neighbours were being pursued to remove or seek to retain buildings within the Green Belt.  Upon investigating the matter, it was considered that the buildings were in fact mobile, therefore didn’t require planning permission.  Despite making this point to the Council, the threat of enforcement action was enough to make one applicant want to safeguard their position, not least in making the case for a cost application against the Council should they serve an Enforcement Notice.  In the end, an agreeable position was reached whereby Bloomfields submitted an application that was approved by the Council, despite reserving the position that no permission was necessary. A potentially lengthy and very costly situation was avoided, meaning that Bloomfield’s client could keep their building without the worry of a planning battle, whilst maintaining a working relationship with the Council.
