Permitted Development Rights will not apply to house proposals if the gross internal floor area is less then 37sqm of any dwelling house, or does not comply with the nationally described Space Standard (as amended in 2016.) Similarly, applications for prior approval that propose to convert retail, commercial, storage or an agricultural building to dwelling, or propose to create new dwellings by demolition or adding storeys will also need to demonstrate that these standards are met.
The requirement to consider space standards will apply to all planning applications, including prior approval applications for development under Permitted Development Rights, from 6 April 2021, other than;
1. Where the prior approval application was submitted before 6 April 2021, including if allowed
2. on appeal (and the prior approval application was submitted before 6 April 2021)
3. Written demonstration that prior approval is not needed and a valid application was submitted before 6 April 2021
4. Prior approval on new homes created by conversion, where the 56-day period determining the application either expires before 6 April 2021 or after the date but a valid application was submitted before that date.
