Sevenoaks District Council have removed two Agricultural Occupancy Conditions tied to a dwelling in rural Sevenoaks which were imposed upon the property in 1949 and 1950 respectively.
This application made under Section 73 of the Town and Country Planning Act 1990 (as amended) formed the second phase of an approach which has been regularly tried and tested by Bloomfields in seeking to remove Agricultural Occupancy Conditions which included, in the first instance, successfully obtaining a Lawful Development Certificate for the use of the dwelling in non-compliance with the relevant conditions.
To support the subsequent S73 application, a valuation of the property was undertaken by Lambert & Foster which identified that the value of the property was such that it made it unaffordable for most agricultural and forestry workers.
The evidence provided to the Council by Bloomfields as part of the application enabled a swift and straightforward decision, which was granted within the statutory determination deadline by the Local Planning Authority.
