Further to a successful Lawful Development Certificate in 2023 which enabled the property’s occupation in breach of its 1962 Agricultural Occupancy Condition, Bloomfields have successfully obtained approval for the full removal of the condition in its entirety. It was comprehensively demonstrated the ‘old style’ AOC would no longer satisfy the modern requirements for planning conditions, as outlined in the National Planning Policy Framework. Furthermore, together with an assessment of the property’s value, Bloomfields successfully provided factual evidence that the property would not be affordable to a genuine farm worker, or even farm manager, and the condition no longer served any useful purpose.
The resulting application and submission then successfully succeeded removing the AOC, allowing the property to realise its full value, free from all planning encumbrances.
