Sevenoaks District Council’s legal challenge to the Inspectors previous decision to withdraw to local plan has now been dismissed. A challenge had been made on the grounds of the duty to co-operate by neighbouring Councils. However, the judge concluded that ‘there is no substance in any of the grounds upon which this claim is advanced and the claimant’s (the Council’s) case must be dismissed’. This means in practice that the District now faces a current housing shortage and being required to commence preparation of a new Local Plan again.
