Maidstone Borough Council did not initially consider that a breach of an Agricultural Occupancy Condition for a farm worker’s cottage could be lawful due to the passage of time, given the extended periods of unoccupancy.
Bloomfields made a thorough analysis of these periods of unoccupancy, which were considered to be a continuance of the breach of condition given the backing of case law. Once this additional information and analysis was submitted to the council, their legal department agreed that a Certificate of Lawfulness should be issued.
