Bloomfields have successfully achieved a Lawful Development Certificate confirming that works had been implemented on a brownfield site in New Romney, ensuring that the scheme for 10 units could continue to be built-out post the expiration of the application.

Having been granted planning permission two days before the Covid Lockdown, the timings to start work on the site were always going to be constrained.  This was coupled with an office move and contamination works and demolition, all of which were required on the site before the development could come forward.

With the Local Planning Authority requiring details to confirm that the application was lawfully implemented, Bloomfields provided a clear timeline of events on the site, in addition to case law setting out that demolition constitutes the start of work.

This positive result has ensured that much needed housing can continue to be delivered in the Romney Marsh area of Kent.  It has also saved time and unnecessary expense for the client and prevented a renewal of the existing permission.
