Bloomfields was approached by a client who had recently had a certification of existing lawfulness refused as the nuances of planning and enforcement legislation had not been fully understood by the applicants. Having analysed the original application, Bloomfields was able to resubmit the certificate of lawfulness and successfully proved that a dog kennel building had been converted to and used as a dwellinghouse for more than the previous 4 years so was therefore immune from enforcement action. A certificate of lawfulness (existing) was issued by Maidstone Borough Council giving the applicants security that no enforcement action could be taken against them.
