Lawful Development Certificate granted for the unrestricted use of an agricultural dwelling on the outskirts of Benenden

The chalet bungalow, on the outskirts of Benenden, had been restricted by a condition which restricted its occupancy to those who made the majority of their income from agriculture or forestry.

Bloomfields successfully argued that the owner-occupiers of the property had actually made the majority of their income through holiday-let accommodation, previously granted on the farm, and on this basis, non-compliance with the condition could be demonstrated that covered a period well in excess of ten continuous years.

The evidence provided to the Council enabled a swift and straightforward decision, which was granted within the statutory determination deadlines.
