Bloomfields recently obtained a Lawful Development Certificate which confirmed that the existing residential use and occupation of the dwellings in breach of the approved use as tourist accommodation was now the property’s recognised lawful use.
Following the grant of the Lawful Development Certificate, Bloomfields successfully demonstrated that the Section 52 Agreement was in conflict with the legal status of the buildings as independent dwellinghouses. Consequently, the Agreement associated with the use of the buildings served no further useful or necessary planning purpose or relevance to the current legal status that exists at the site.
The removal of the legal agreement makes the properties capable of being marketed at full and unencumbered market value.
