S106 Removal Success

Bloomfields successfully secured the discharge of a S106 Agreement, the covenants of which required that the property was to be used only as an agricultural dwelling, and that said agricultural dwelling should not be disposed of in isolation from the land which the S106 was intended.

Bloomfields demonstrated that the S106 obligations that tie ownership of an agricultural dwelling to a specific land holding are no longer regarded as appropriate, and such obligations place an unwarranted restraint on land ownership and are not reasonable or necessary. Consequently, the S106 Agreement no longer serves a useful purpose and should be discharged, a view the Local Planning Authority and their Legal Team agreed with.

The discharge of the S106 Agreement now permits the landowner to dispose of two recently approved residential barn conversions separate to the dwellinghouse and removes the legal covenant restricting the property to only be used as an agricultural dwelling.
