Retrospective planning permission was originally granted in 2008 for a temporary storage use on our clients’ land which was conditioned to cease by no later than 3 years from the date permission was granted.
The storage use continued in breach of the condition which led to a planning enforcement investigation being carried out by the Council.
Following communications with Council officers, Bloomfields were instructed to prepare and submit an application for a Certificate of Lawfulness of Existing Use whereby a robust evidential case was presented to demonstrate that the breach of planning condition had been taking place for in excess of 10 years and a Lawful Development Certificate was subsequently granted by the Local Planning Authority.
