Despite the appeal for the retrospective forestry building being dismissed, Bloomfields successfully argued that Tunbridge Wells Borough Council and the Forestry Commission’s interpretation and classification of a woodland area as ancient woodland was incorrect. After a thorough analysis of historic mapping, both locally and nationally, Bloomfields was able to prove that the woodland had not been continuously wooded since the 1600’s. The Inspector agreed with this analysis and confirmed Bloomfields’ assertion that just because a few ancient woodland indicator species may be present, this does not indicate the continuous wooded nature and statutory definition is met for it to be classed as ancient woodland.
