Bloomfields has successfully removed an Agricultural Occupancy Condition from a 1990 planning permission requiring the dwelling be only occupied by a person employed, or last employed, locally in agriculture or forestry, or by a dependant of such a worker.
The application to remove the condition followed a successful Lawful Development Certificate to demonstrate a continued 10 year breach of the condition. Clear and compelling arguments were presented to the Local Planning Authority sufficient to enable them to remove the condition in its entirety.
Our client’s property has now increased in value as a result of the removal of the condition which also now enables him to source a more favourable high street mortgage, rather than a commercial agricultural loan.
