Following the refusal of prior approval to extend a semi-detached property with a 6m rear extension under permitted development, on the grounds that it would result in an overbearing visual impact and overshadow neighbouring amenities, Bloomfields took this determination to appeal and, supported by a Daylight and Sunlight Assessment, argued that a single storey extension would not result in the harmful impacts suggested by the Local Authority.
The Inspector ultimately agreed with Bloomfields’ stance and allowed the appeal, stating that;
“the proposed flat roof design means that, overall, the appeal proposal’s height, scale and bulk would not be of a level which would give rise to significant additional overshadowing, nor an undue sense of enclosure [of the neighbouring property and its garden area]. Neither would its overall presence significantly reduce the current aspect enjoyed by those occupants to an extent that would be overbearing.”
